This Telehealth Consent explains how virtual health care works, its benefits, limitations, risks, and your responsibilities as a patient of Nexon Health Care LLC.

Please review this form before your first telehealth visit.

What Telehealth Means

Telehealth uses electronic communication technology to provide health care when the patient and provider are in different locations.

Telehealth services may include:

  • Video visits

  • Audio communication when clinically appropriate

  • Secure messaging

  • Review of medical records

  • Medication management

  • Laboratory ordering and review

  • Patient education

  • Follow-up care

  • Referral coordination

  • Transmission of health information

Florida law allows telehealth for assessment, diagnosis, consultation, treatment, monitoring, transfer of medical information, and related health care services. The provider must follow the same prevailing professional standard of care applicable to in-person services. (Online Sunshine)

Eligibility for Services

Nexon Health Care currently provides telehealth services to:

  • Adults age 18 and older

  • Patients physically located in Florida at the time of the visit

  • Patients whose condition is appropriate for virtual evaluation

You must tell the provider your physical location at the beginning of each visit.

The provider may stop or decline the visit if:

  • You are outside Florida

  • Your identity or location cannot be confirmed

  • Your condition requires an in-person examination

  • The technology is not adequate for safe care

  • The provider determines telehealth is clinically inappropriate

Under Florida law, health care delivered through telehealth is treated as occurring where the patient is located. (Online Sunshine)

How the Visit Works

During your telehealth visit, the provider may:

  • Confirm your identity

  • Confirm your current location

  • Confirm your emergency contact

  • Review your symptoms

  • Review your medical history

  • Review medications and allergies

  • Review available laboratory or imaging results

  • Ask you to perform parts of a guided examination

  • Ask you to provide home measurements

  • Discuss diagnosis and treatment options

  • Order laboratory testing

  • Prescribe medication when appropriate

  • Recommend in-person care or referral

The provider will document telehealth services in your medical record using the same documentation standard applied to in-person services. (Online Sunshine)

Possible Benefits

Potential benefits of telehealth include:

  • Access to care from home

  • Reduced travel time

  • More convenient scheduling

  • Earlier clinical evaluation

  • Easier follow-up

  • Review of medications and test results

  • Improved continuity of care

  • Access for patients with transportation or mobility barriers

Benefits are not guaranteed.

Limitations of Telehealth

Telehealth does not provide the same examination capability as an in-person visit.

The provider may be unable to:

  • Perform palpation

  • Auscultate the heart or lungs directly

  • Perform a complete neurologic examination

  • Examine the abdomen fully

  • Inspect certain skin, ear, throat, eye, or genital findings adequately

  • Obtain immediate vital signs

  • Perform diagnostic procedures

  • Obtain laboratory testing or imaging during the visit

  • Identify all serious conditions through video alone

Telehealth limitations may lead to:

  • Incomplete information

  • Delayed diagnosis

  • Misdiagnosis

  • Need for repeat evaluation

  • Need for urgent care

  • Need for emergency department evaluation

  • Need for specialist referral

  • Need for in-person examination

You agree to follow recommendations for in-person evaluation when the provider determines telehealth is insufficient.

Technology Risks

Telehealth depends on electronic systems.

Possible technology problems include:

  • Poor internet connection

  • Audio failure

  • Video failure

  • Delayed transmission

  • Interrupted communication

  • Device malfunction

  • Platform outage

  • Unauthorized access

  • Accidental disclosure

  • Loss or corruption of electronic information

If the connection fails, the provider may:

  • Reconnect through the telehealth platform

  • Contact you by telephone

  • Reschedule the visit

  • Direct you to in-person care

  • Direct you to emergency services when necessary

Privacy and Confidentiality

Nexon Health Care uses secure systems and safeguards designed to protect your health information.

Telehealth services provided by covered health care providers must comply with HIPAA privacy and security requirements. Covered providers must use vendors that meet applicable HIPAA requirements and execute business associate agreements when required. (telehealth.hhs.gov)

Despite safeguards, electronic communication carries privacy risks.

You should:

  • Participate from a private location

  • Use a secure internet connection

  • Avoid public Wi-Fi when possible

  • Use headphones when privacy is limited

  • Prevent others from viewing or hearing the visit

  • Protect your device and passwords

  • Tell the provider if another person is present

  • Avoid recording the visit unless everyone agrees

If another person is observing or participating in the visit, the provider should identify that person and obtain your consent. HHS recommends documenting telehealth consent and confirming any observers at the start of the encounter. (telehealth.hhs.gov)

Recording

Neither you nor Nexon Health Care should record the visit without prior agreement from all participants.

Unauthorized recording may violate privacy laws or practice policy.

If a recording is created with proper consent, it may become part of the medical record.

Patient Responsibilities

You agree to:

  • Provide complete and accurate information

  • Disclose all medications and allergies

  • Disclose relevant medical history

  • Disclose pregnancy status when relevant

  • Tell the provider about worsening symptoms

  • Provide accurate home measurements

  • Use prescribed medication as directed

  • Complete recommended laboratory testing

  • Follow referral and follow-up instructions

  • Seek in-person or emergency care when advised

  • Maintain privacy during the visit

  • Avoid driving during the visit

  • Avoid participating while impaired by alcohol or drugs

  • Confirm who is present during the visit

  • Keep your contact information current

You understand that incomplete or inaccurate information may affect diagnosis and treatment.

Home Measurements

The provider may ask you to provide:

  • Blood pressure

  • Heart rate

  • Temperature

  • Oxygen saturation

  • Weight

  • Blood glucose

  • Other home measurements

You are responsible for using functioning equipment and reporting measurements accurately.

The provider is not responsible for inaccurate data caused by defective devices, poor technique, or incorrect reporting.

Prescriptions

A telehealth visit does not guarantee a prescription.

The provider will prescribe medication only when clinically appropriate and legally permitted.

The provider may require:

  • Medical records

  • Laboratory testing

  • Pharmacy verification

  • Prescription monitoring review

  • In-person examination

  • Follow-up evaluation

  • Specialist consultation

 

Nexon Health Care does not provide chronic opioid management or routine Schedule II prescribing through its standard telehealth service.

Florida law generally prohibits prescribing Schedule II controlled substances through telehealth except for specific statutory circumstances. (Online Sunshine)

Medication risks, benefits, alternatives, interactions, and monitoring requirements will be reviewed when applicable.

Laboratory Testing and Referrals

The provider may order testing through an outside laboratory.

You understand:

  • Laboratory charges are separate from the visit fee

  • The laboratory may bill you or your insurance

  • You are responsible for completing ordered testing

  • Delayed testing may delay diagnosis or treatment

  • Abnormal results may require urgent follow-up

  • Certain findings require in-person care

The provider may refer you to:

  • Primary care office

  • Urgent care

  • Emergency department

  • Specialist

  • Imaging facility

  • Laboratory

  • Other health care service

Emergency Care

Nexon Health Care does not provide emergency medical care.

Do not use telehealth, secure messaging, email, website forms, or appointment requests for an emergency.

Call 911 or go to the nearest emergency department for:

  • Chest pain

  • Severe shortness of breath

  • Stroke symptoms

  • Severe allergic reaction

  • Uncontrolled bleeding

  • Loss of consciousness

  • New severe weakness

  • Seizure

  • Suicidal thoughts

  • Psychiatric emergency

  • Severe abdominal pain

  • Rapidly worsening symptoms

  • Any life-threatening condition

At the beginning of the visit, the provider may confirm your location and emergency contact to support emergency planning.

Fees and Payment

Nexon Health Care is a cash-pay practice.

You understand:

  • Payment may be required before the visit

  • Telehealth fees do not include laboratory, imaging, pharmacy, emergency, specialist, or outside-facility charges

  • A visit fee pays for the provider’s evaluation and professional time

  • A diagnosis, prescription, antibiotic, laboratory order, or treatment outcome is not guaranteed

  • Cancellation and no-show policies apply

  • Membership benefits apply according to the membership terms

Alternatives to Telehealth

Alternatives include:

  • In-person primary care

  • Urgent care

  • Emergency department care

  • Specialist care

  • Hospital evaluation

  • Choosing not to receive care from Nexon Health Care

You may decline telehealth.

Declining telehealth does not prevent you from seeking care from another provider.

Withdrawal of Consent

You may withdraw consent to telehealth at any time.

Withdrawal will apply to future telehealth services and will not affect care already provided or documentation already created.

Withdrawal may limit Nexon Health Care’s ability to continue treating you through this practice because the current model is telehealth-based.

No Guarantee of Outcome

Medicine involves uncertainty.

Nexon Health Care does not guarantee:

  • A specific diagnosis

  • A prescription

  • Antibiotic treatment

  • Laboratory testing

  • Referral approval

  • Symptom resolution

  • A particular clinical outcome

The provider will use professional judgment based on the information reasonably available during the encounter.
